Welcome to WellNest. These Terms and Conditions ("Terms") govern your access to and use of this website and your purchase of products from our store (together, the "Services"). By browsing the website, creating an account or placing an order, you confirm that you have read, understood and agreed to these Terms. If you do not agree, please do not use the Services.

1. About us

This store is operated by WellNest, 12 Alex Street, Diepsloot, Gauteng, 2189, South Africa. You can reach us at smierristerris@gmail.com. References to "we", "us" and "our" mean WellNest, and "you" means the person visiting the website or placing an order.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. By placing an order you confirm that the information you give us is accurate, current and complete.

3. Products and pricing

We take care to describe and photograph our products accurately, but colours and finishes may vary slightly depending on your screen and on natural variation in materials.
All prices are shown in South African Rand (ZAR) and include VAT where applicable, unless stated otherwise. Delivery costs are shown at checkout before you pay.
We may change prices, or discontinue products, at any time without notice. A price change will not affect an order that has already been confirmed.
If a product is listed at an incorrect price or description because of an obvious error, we may cancel the order and refund you in full.

4. Orders and payment

Placing an order is an offer to buy. Your order is accepted when we send you an order confirmation. We may decline or cancel an order, for example because of stock availability, a pricing error, or suspected fraud, and will refund any payment made. Payment is processed securely through Shopify and our payment providers. We do not store your full card details.

5. Delivery

We aim to dispatch orders promptly and will provide delivery estimates at checkout. Estimates are not guaranteed, and delays caused by couriers, weather, public holidays or other events outside our control do not make us liable for loss. Risk in the goods passes to you when they are delivered to the address you provided. Please make sure your delivery address is correct, as we cannot be responsible for orders sent to an incorrect address supplied by you.

6. Returns and refunds

Our returns and refund rules are set out in our Refund Policy, which forms part of these Terms. In short, you may request a refund within 5 days of receiving your order, subject to the conditions in that policy.

7. Your account

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately if you suspect unauthorised use.

8. Acceptable use

You agree not to: use the Services for any unlawful purpose; attempt to gain unauthorised access to our website, systems or other users' data; introduce viruses or other harmful code; scrape or copy our content without permission; or use the Services in a way that could damage, disable or overburden them.

9. Intellectual property

All content on this website, including text, images, logos, product descriptions and design, belongs to WellNest or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute or use it commercially without our written permission.

10. Disclaimer and limitation of liability

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the Services, and our total liability for any claim relating to an order is limited to the amount you paid for that order.

11. Your statutory rights

Nothing in these Terms limits or excludes any rights you have under South African law that cannot be limited or excluded, including your rights under the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.

12. Privacy

We handle your personal information in accordance with our Privacy Policy and applicable law, including the Protection of Personal Information Act 4 of 2013 (POPIA).

13. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date, and will apply to orders placed after that date.
